Controversial lawyer Miguna Miguna has filed a suit against five top government officials for contempt of court over failure to return his passport.

The officials cited in the contempt suit are Interior Cabinet Secretary Fred Matiang’i, former Immigration boss Gordon Kihalangwa, Directorate of Criminal Investigations head George Kinoti, and chief prosecutor Noordin Haji.

Miguna through his lawyer, Mr John Khaminwa, also wants former Inspector-General of Police Joseph Boinnet held in contempt for disobeying court orders issued in 2018.

Return passport

The senior government officials failed to comply with court order to return Miguna’s passport after he was forcibly ejected from the country and taken to Canada.

In court documents filed on Wednesday at Milimani Law Courts, the controversial politician-cum-lawyer says the continued holding of his passport is illegal.

Miguna claims he is languishing in a foreign land and wants to return home.

He says he has been unfairly hindered from returning to his motherland which is unconstitutional.

Some of the respondents, Miguna says, are not in office having been replaced and wants the court to punish them for having failed in duty while in office.

The orders were issued on December 14, 2018.

“The 2nd and 3rd respondents Gordon Kihalangwa and Joseph Boinnet are not currently in office as they have been replaced as per the direction of the President,” Mr Khaminwa says.

But Maj-Gen (rtd) Dr Gordon Kihalangwa is now the Defence Principal Secretary while Boinnet is the Tourism Chief Administrative Secretary.
