Deputy Chief Justice Philomena Mwilu has assured Kenyans that the Supreme Court bench will work as a team over the weekend to deliver a comprehensive judgment after listening to the submissions of lawyers representing the presidential election petitioners, respondents, and interested parties enjoined in the case.
Chief Justice Martha Koome adjourned the apex court to Monday, September 5, 2022, when the seven-judge-bench is expected to deliver a judgment.
Azimio’s presidential flagbearer Raila Odinga had filed a petition at the Supreme Court challenging IEBC’s declaration of Deputy President William Ruto as the winner of the August 9th presidential contest.
In her closing remarks, DCJ Mwilu made what seemed like a veiled reference to the division among commissioners of the Independent Electoral and Boundaries Commission.
Mwilu averred that judges at the apex court work as a team and consider themselves equals.
“We work as a team here. We divide roles. We consider ourselves equals. None of us has veto power but of course, we have a team leader. Pray for us as we undertake the next phase,” she said.

Mwilu also appealed for prayers as they retire to write their judgments.
“It is not the most difficult part as you have helped us with the more difficult part but it is intense, for which, we ask you that you pray to whatever God you pray to; that we may have a very high sense of discernment, and that we shall return to Kenya a judgment not less than what Kenyans expect,” she said.
