Sonko graft case: Court summons Capitol Hill OCS Tusca Opondo

Milimani Anti-Corruption Principal Magistrate Charles Ondieki has summoned Capitol Hill Officer Commanding Station (OCS) Tusca Opondo to appear before him.

Magistrate Ondieki ordered the OCS to appear in court on Wednesday, February 4, 2026, for the former Nairobi governor Mike Sonko graft case defence proceedings.

The court summons came following an application made by Sonko’s legal team on Tuesday, February 3, 2026, requesting OCS to appear as a witness in the case.

The defence team informed the court that OCS Opondo’s evidence is crucial to the ongoing proceedings and also important to ensure that justice is served.

They told the court that the OCS would be required to present to court an OB that was recorded at Capitol Hill by Sonko on a WhatsApp call that he received from Jambo Pay director Danson Muchemi via Agnes.

“Your honour, Mr Tusca will be producing the OB extract and the OB that contains the contents of a report that was made by the first accused person,” the defence team told the court.

The application to have Opondo testify came after Police Constable Halili Waweru Mswadiki, attached to Capitol Hill Police, took to the dock, confirming the former county boss sought assistance from the station on the said recorded WhatsApp call.

Appearing before Magistrate On Tuesday, February 3, 2026, Officer Mswadiki told the court that on July 26, 2025, Sonko made a report regarding a conference WhatsApp phone call that he had received at 1335 hours.

According to Officer Mswadiki, in his statement, Sonko stated that Muchemi started provoking him, leading to some exchange of words between them, and he decided to report him to get police assistance.

After reporting, Mswadiki told the court that he also listened to the recorded call, after which he proceeded and produced an OB.

However, he told the court that a copy of the clip was not left at the station.

Mswadiki told the court that after the complainant left, he proceeded to report the matter to the station’s OCS office.

The OCS told him that the matter would be forwarded to the Directorate of Criminal Investigations (DCI) Kilimani for investigations.
