EACC disapproves of DPP’s directive to investigate voter transfer claims

The Ethics and Anti-Corruption Commission (EACC) has disapproved a directive issued by the Director of Public Prosecutions (DPP) regarding the probing of alleged illegal voter transfers.

In a letter directed to DPP Noordin Haji, EACC CEO Twalib Mbarak noted that any case or claims involving elections do not fall under the mandate of the anti-graft body adding that the DPP should instead direct the Independent Electoral and Boundaries Commission (IEBC) to investigate the matter.

“Please note that the alleged illegal registration and transfers of voters do not fall within the mandate of the EACC and it is hereby recommended that IEBC deals with the matter in accordance with their mandate,” the letter dated Friday, August 5, 2022, reads in parts.

DPP Haji writes to EACC

Mbarak’s response comes a day after DPP Haji wrote to the agency directing them to investigate the irregular vote transfers witnessed in Eldas constituency in Wajir and Balambala, Garissa county.

“I hereby direct that you institute comprehensive investigations into the said allegations and thereafter submit the resultant investigation for perusal and further directions,” Haji wrote.

Among those allegedly involved in the case at hand are; IEBC ICT officer Garissa Adan Salah, who is the former ICT officer in Wajir, returning Officer Ijara Constituency and former returning officer Eldas Issack Muhumed and the returning officer Wajir North Abdulahi Musa Mohammed, who is also the former returning officer Balambala, former deputy returning officer Balambala Mohammed Maow Abdi and the returning officer Balambala Ali Noor Hussein.
