High Court rules EPRA boss Daniel Kiptoo is not guilty in contempt case

Energy and Petroleum Regulatory Authority (EPRA) Managing Director Daniel Kiptoo Bargoria has gotten a major reprieve after the High Court found him not guilty of disobeying court orders over hiking of fuel prices in July.

In a ruling rendered by Justices David Majanja, Christine Meoli and Lawrence Mugambi, the court discharged the EPRA boss of accusation of contempt of court saying that the evidence presented before did not show that he disobeyed court orders.

While freeing Kiptoo, the judges said that by the time he issued the notice increasing fuel prices, he had no knowledge of the order issued by Justice Mugure Thande barring the state from implementing the Finance Act 2023.

“We find that the EPRA boss did not have knowledge of the order by the time he issued the press release hiking fuel. Further, we find that the petitioner (Okiya Omtatah) did not prove the disobedience of the order. We find that Bargoria is not guilty of contempt of court and is discharged,” Justice Meoli ruled.
