MP Nabii sues Savula for alleging he is HIV positive, seeks Ksh100M compensation

The Lugari Member of Parliament (MP) Nabii Nabwera has sued the Kakamega Deputy Governor Ayub Savula over defamatory statements that he made alleging that he is HIV-positive.

According to the court papers, Nabii states that Savula, while in a burial ceremony on November 25, 2025, unprovoked, uttered defamatory, inaccurate and injurious statements about him in respect to his HIV status.

“That the respondent (Savula) personally uttered the words “…shule zetu zinaanguka sababu ya huyu mtu amekondakonda ako na ukimwi…”, which words he used to refer to the said area member of parliament, the applicant (Nabii), among a spate of other derogatory statements,” part of the application read.

The legislator argues that the said statements are malicious, derogatory, defamatory, inaccurate and injurious statements which he says are in a bid to malign him in his capacity as the Lugari MP.

Nabii, through his lawyer Danstan Omari, wants the court to compel Savula to tender an unequivocal public apology and retract all the injurious, defamatory and derogatory statements he made in respect of the HIV status and performance record of the herein, to wit, “…shule zetu zinaanguka sababu ya huyu mtu amekondakonda ako nа ukimwi.”

Further, Nabii wants the court to issue orders barring DG Savula and his agents from making any defamatory statements aimed at him until his application is heard and determined.

“Pending the hearing and determination of this application and suit, this court be and is hereby pleased to direct the respondent (Savula) to be and is completely barred from personally, through his agents, servants, cronies, proxies or people working under his instructions, from making any defamatory, derogatory and maligning statement, both personal and political, aimed at tarnishing and negatively painting the applicant’s (Nabii’s) name in a bad light, in his capacity as the member of parliament for Lugari Constituency,” part of the orders sought read.

Notably, pending the hearing and determination of the application, the legislator also wants the court to compel Savula to compensate him Ksh100 million for the damages he has caused him that he says have damaged his reputation, spanning both global and domestic influence.
