Court orders DCI, IG to pay blogger Ndiangui Kinyagia Ksh5M over unlawful house raid

The High Court has ordered the Director of Criminal Investigations (DCI) Mohamed Amin and Inspector General of Police (IG) Douglas Kanja to pay blogger and IT expert Ndiangui Kinyagia Ksh5 million for unlawful intrusion into his house.
In a judgment delivered by Justice Patricia Nyaundi on Tuesday, September 22, 2026, the court ruled that the DCI’s and IG actions to invade his house and get away with some of his items, which included passports, laptops, phones, and other things, were illegal.
Judge Nyaundi found that by invading Ndiangui’s house and taking away his personal items, both the DCI and IG violated his rights to privacy, property, dignity, freedom, security of the person, and freedom of movement.
“I am satisfied that there is no foundation, and the police did not first obtain lawful authority and then investigate; they invaded, searched, and seized, and only thereafter sought to clog their conduct with the appearance of legality,” Justice Nyaundi ruled.
“General damages are awarded in the sum of Ksh5 million, payable jointly by the first and second respondents (DCI and IG),” the judge added.
Further, the court has barred the Directorate of Public Prosecution (DPP) from instituting any prosecution against the IT expert arising from the unconstitutional investigative process undertaken by the DCI and the IG.
Officers from DCI invaded Ndiangui’s residence on June 21, 2025, and remained at the premises for the better part of the day attempting without success to reach him.
When the efforts did not yield any fruits, the DCI officers forcibly entered his house and removed the evidence, leaving a copy in the inventory with the caretaker.
Meanwhile, the court noted that Ndiangui reported he went into hiding after learning about the presence of DCI officers at his residence and feeling apprehensive for his safety due to the prevailing national environment.
