Court sets date for judgement in the Samidoh rape case

The Milimani High Court has set next year to deliver a judgement in a case where a celebrated Mugithi artiste, Samuel Muchoki Ndirangu, alias Samidoh, is accused of sexual assault by a Kenyan-American woman.
The woman sued the Inspector General of Police (IG), the Director of Criminal Investigations (DCI), the Director of Public Prosecutions (DPP), and the Attorney General (IG) for failing to discharge their statutory and constitutional obligations over the sexual offence.
According to court papers, the woman states that she formally lodged a complaint with the DCI on June 12, 2025, against Samidoh, but despite her efforts, the institution has failed to register, investigate, or advance her complaint.
Legal assistance framework
The woman referred to as M.R.W. for protection purposes also avers that the DCI has equally failed to invoke the mutual legal assistance framework to obtain certified evidence from the United States.
When the matter came up for directions on Monday, July 20, 2026, Justice Patricia Nyaundi set February 11, 2027, for the delivery of the judgement in the case.
Further, she has directed the IG, DCI, DPP, the Witness Protection Agency (WPA) and Samuel Muchoki, listed as the interested party, to file responses to the case by August 4, 2026.
“The respondents (IG, DCI, DPP, WPA) and the interested party (Samidoh) are to file their responses within 14 days, not later than August 4, 2026. The petitioner is to file another affidavit alongside written submissions within 14 days of service or not later than August 20, 2026,” Judge Nyaundi directed.
“The respondents and interested party are to file their submissions within 14 days of service or not later than September 5, 2026. Petitioner granted leave to file supplementary submissions,” Justice Nyaundi added.
M.R.W., in her petition, states that Samidoh lured her into a short-stay house in Overland Park, Kansas, and forced himself on her against her wishes despite her persistent resistance to the said act.
“On or about November 28, 2021, while Samuel Muchoki Ndirangu, alias Samidoh, was in the United States for a music performance, he lured me into his Airbnb in Overland Park, Kansas, and raped me. I repeatedly refused and resisted, but he mocked my protestations, ignored my pleas, and, without my consent whatsoever, committed the sexual offence,” part of the court papers read.
The lady also reveals that after the incident, she filed a report with the Overland Park Police Department, Kansas, and a case was opened as Case No. 2023022021 under the classification of rape.
