The Employment and Labour Relations Court in Nairobi has deferred the sentencing of convicted Health minister Mutahi Kagwe to November 23, 2020.

This is after CS Kagwe moved to the Court of Appeal to overturn Labour Court’s conviction for contempt.

The Health CS obtained a Court of Appeal order stopping his sentencing until November 20, 2020, when the matter will be heard at the appellant court.

If the Appellate Court upholds the conviction then the Labour Court will issue his sentence three days after.

Justice Onesmus Makau convicted him for contempt of court after he initiated the transfers of the National Quality Control Laboratory (NQCL) chief executive officer and deputy director despite the existence of an order barring their reposting.

The judge, who indicated that he has been transferred to Kisumu Law Courts, ordered the CS to appear at the Nairobi Labour Court on November 23.

NQCL chief executive, Dr. Hezekiah Chepkwony and his deputy director, Dr. Pius Wanjala, had moved to court challenging their transfers.

Dr. Chepkwony had been posted to the Kenya Medical Training College whereas Dr. Wanjala had been moved to the Moi Teaching and Referral Hospital in Eldoret.

The two NQCL bosses were granted the court order on January 31, 2020, stopping the transfers from being implemented.
