Lawyer Ahmednasir Abdullahi has vowed to make a comeback at the Supreme Court of Kenya after being barred from appearing before the apex court.
In a statement on Tuesday, January 23, 2024, Ahmednasir said he would return when Justices Mohamed Ibrahim, Isaac Lenaola and William Ouko were the only judges remaining out of the current team.
“Now that Chief Justice Martha Koome today read the order of the Court where 6 judges recused themselves from the case I was to argue and further baring me from the court as long as they (are) members of the Court…I’m ready to make peace with the court as follows: I will not take a brief or appear before the Supreme Court as long as CJ Koome, DCJ (Philomena) Mwilu, Smokin Wanja and Njoki (Ndung’u) are judges of the Supreme Court Kenya,” Ahmednasir stated.
“I will come back to the Court (InshaAllah) if and when Justices Ibrahim, Lenaola, Ouko and other new members constitute a majority in the Supreme Court.”
On Tuesday, Ahmednasir was barred from appearing before the Supreme Court to represent a family in a Ksh2 billion land case pitting the family of former President the late Daniel Moi.
The case was adjourned until Ahmednasir left the case, with six judges recusing themselves from the case.
Ahmednasir banned
On January 18, the Supreme Court banned Ahmednasir from appearing before it, following several attacks and allegations of corruption by the lawyer against judges.
The decision was reached unanimously by the seven judges of the Supreme Court, which affects his law firm and his employees.
“In view of the foregoing, it is the decision of this Court, that henceforth and from the date of this Communication, you shall have no audience before the Court, either by yourself, through an employee of your law firm, or any other person holding brief for you, or acting pursuant to your instructions. Much as this decision is bound to affect those who may have instructed you to represent them before the Court, it is untenable that you would seek justice in the very institution and before the very Judges, whose reputation and integrity you never tire in assaulting,” the Supreme Court Registrar wrote in the letter to the Senior Counsel.
The Supreme Court said it decided so since the lawyer has over the years engaged in a campaign to scandalize and ridicule the top court in the country court.
“Over the years, you have relentlessly and unabashedly conducted a campaign in the broadcast, print and social media aimed at scandalizing, ridiculing and out-rightly denigrating this Court. Through social media posts, media interviews and write-ups, you have accused the Court either in its constitutive persona, or individual membership, of acts of corruption, incompetence and outright bribery. This, you have done with reckless abandon, paying scant regard to the reputations of those who tirelessly serve on the Court in accordance with their Oath of Office,” the letter added.
