DPP seeks jail terms for ex-Migori governor Obado, 2 others in Sharon Otieno murder case

The Director of Public Prosecutions (DPP) wants the court to jail former Migori Governor Zacharia Obado, his former aide Michael Oyamo and Casper Ojwang over Sharon Otieno’s death.
In their final submissions filed in court, the prosecution argues that it has proved its case against the three accused persons beyond a reasonable doubt.
According to the DPP, the evidence adduced reveals that the former county boss, Obado, was the beneficiary of the actions of his personal aide, Oyamo, and Casper, the third accused, in the death of the deceased.
Further, the State cites that Oyamo and Casper were trusted operatives acting in furtherance of a common design.
“The 2nd and 3rd accused (Oyamo and Casper) were present near or at Graca Hotel on the evening of September 3, 2018, when the deceased and XYZ were abducted,” the DPP states in the submissions.
Notably, the prosecution avers that the car used in the abduction and subsequent killing of the deceased was driven by the long-time operator of KCL 481K, a vehicle owned by Casper’s wife.
The DPP, through Senior Assistant Director of Public Prosecutions Gikui Gichui, states that they have established, through the evidence adduced, that Oyamo and Casper procured false medical records which Oyamo sought to use to mislead the police.
“The accused persons acted with common intention towards a common aim,” State Counsel Gichui adds.
Notably, she states that the defence evidence is full of afterthoughts, false narratives and concealment that raise inconsistencies. The accused persons’ defences and testimony do not raise any reasonable doubt.
The prosecution has urged the court to find that Obado, Oyamo and Casper are responsible for the death of the deceased and should be jailed for her murder.
“This Court is therefore urged to find that the prosecution has discharged its burden and to enter convictions against all the accused persons, finding them guilty as charged for the murder of Sharon Otieno,” the prosecution states in its submission.
