IEBC sued for locking out Embakasi North from voter registration

A city lawyer, Joseph Kinuthia Nyambura, alias Lawyer wa Mtaa, has moved to the High Court seeking conservatory orders compelling the Independent Electoral and Boundaries Commission (IEBC) to include Embakasi North Constituency in the list of constituencies where the voter registration exercise is going on.

Through a certificate of urgency, dated October 2, 2025, Kinuthia states that pursuant to gazette notice No. 12009, dated August 27, 2025, the chairperson of the IEBC, Erastus Edung Ethekon, announced the commencement of continuous voter registration in several constituencies with the exception of Embakasi North Constituency.

The petitioner argues that IEBC’s actions have significantly disenfranchised voters and potential voters residing in Embakasi North Constituency, as the process already commenced in earnest on September 29, 2025, in many constituencies countrywide.

“That the delay and indefinite suspension of the voter registration process in Embakasi North Constituency is likely to have significant ramifications, especially on the number of newly registered voters, as the process will begin later than in most constituencies,” lawyer Kinuthia states.

Further, he states that the rights of the Embakasi North Constituency electorates have been infringed by the IEBC’s action by the fact that there is a scheduled by-election in the Kariobangi North ward.

Wants IEBC compelled to review areas

Kinuthia, who also states that he is a registered voter within Embakasi North Constituency, wants the court to compel IEBC to review the gazette notice No. 12009 and include Embakasi North Constituency in the list pending the hearing and determination of his petition.

“That pending the hearing and determination of this application herein, a conservatory order be issued compelling the Respondent (IEBC), whether by itself, its officers, servants, agents, or any person acting under its authority, to review gazette notice No. 12009 dated 27th August 2025 and include Embakasi North Constituency in the list of constituencies to forthwith commence the continuous voter registration process with the exclusion of Kariobangi-North Ward,” Kinuthia states in his application.

“That pending the hearing and determination of the petition, a mandatory injunction be issued compelling the respondent (IEBC) to review gazette notice No. 12009 dated August 27, 2025, and include Embakasi North Constituency in the list of constituencies to forthwith commence the continuous voter registration process excluding Kariobangi North Ward,” part of the application read.
