Gloria Orwoba surrenders, withdraws case against UDA, Senate and IEBC

Former nominated United Democratic Alliance (UDA) Senator Gloria Magoma Orwoba has withdrawn a petition she filed at the Milimani Constitutional and Human Rights Division seeking a conservatory order quashing a gazette notice declaring her position vacant.

Through a certificate of urgency, Orwoba argued that the May 21, 2025, gazette notice, Vol. CXXVII, number 97, which declared a vacancy of the seat she held in the Senate, was null and void.

In the prayers sought, she also wanted the court to block the implementation of the decision of the Independent Electoral and Boundaries Commission (IEBC) in a gazette notice, Volume CXXVII, number 173, dated August 15, 2025, nominating Consolata Wabwire in her place.

Further, she sought to have the court issue a conservatory order blocking the swearing in of her successor, Senator Consolata, to take her position in the Senate.

She argued that the gazettement of Consolata to take her place in the Senate by the IEBC was based on a purely void decision.

According to Orwoba, the decision of the IEBC to gazette and the gazette notice by the Senate to swear in Consolata were marred by unlawfulness and procedural improprieties that warrant the High Court’s intervention at the first instance.

On August 18, 2025, the Senate, through a gazette notice, Vol. CXXVII number 174, communicated that Consolata was to be sworn in on August 20, 2025, as the new nominated UDA Senator.

Orwoba’s application

Notably, in her application, the politician wanted the court to declare the decision of UDA, the National Senate, IEBC, and the office of the Registrar of Political Parties to expel her from UDA’s membership and remove her from the party’s register as unconstitutional, unlawful, null, and void.

“A declaration that the respondents (UDA, the National Senate, IEBC, and the office of the Registrar of Political Parties) infringed on the petitioners’ (Orwoba) political rights, rights to administrative actio,n and the right to a fair hearing,” part of Orwoba’s application read.

Appearing before Justice Chacha Mwita on Thursday, September 18, 2025, lawyer Ombaso, representing the former senator, told the court that he filed a notice to withdraw the matter on August 20, 2025.

Further, he requested the court to have the matter marked withdrawn and the file closed.

“It is my request that the same petition be marked as withdrawn,” lawyer Ombaso told the court.

Judge Mwita closed the file as requested by the petitioner (Gloria Orwoba); “the petition is marked withdrawn,” Justice Mwita stated.
