ODPP sends message of condolence following passing of Magistrate Kivuti

The Office of the Director of Public Prosecutions (ODPP) has sent a message of condolences following the tragic passing of Magistrate Monica Kivuti.

Kivuti succumbed to injuries sustained during a shooting incident in court.

At the time of her death, Magistrate Kivuti was serving as the Principal Magistrate at the Makadara Law Courts in Nairobi.

“The Office of the Director of Public Prosecutions conveys its deepest sympathies to the family, friends, Judiciary, and entire nation following the untimely passing of Hon. Monica Kivuti following a shooting incident at her workplace. At the time of her death, Hon. Kivuti was serving as the Principal Magistrate at the Makadara Law Courts in Nairobi. Hon. Kivuti was a dedicated jurist and beacon of integrity and justice in our judicial system,” the statement by ODPP stated.

Adding;

“Her commitment to upholding the rule of law and ensuring fairness in her line of duty earned her respect and admiration among her colleagues and the public. The circumstances surrounding her death are tragic and deeply regrettable. During this difficult time, our thoughts are with Hon. Kivuti’s family, friends and colleagues. May they find strength and solace in the memories of a remarkable individual whose contribution to the nation will be dearly missed.”

Koome confirms Kivuti’s death

The death of Monica Kivuti was confirmed by Chief Justice Martha Koome.

“It is with a heavy heart that I inform the nation that Hon. Monica Kivuti, Principal Magistrate, Makadara Law Courts, has lost the fight against the extensive injuries sustained during an open gun attack in court. We condole with the family, friends, and the entire judiciary fraternity during this very difficult period of mourning,” Koome stated.

Adding;

“The Judiciary family stands in solidarity during this deeply traumatic time and calls for sensitivity and compassion as we share in grief. May Hon. Kivuti’s soul rest in eternal peace.”

Magistrate Kivuti died at Nairobi Hospital, where she was taken for specialized treatment after the attack. Her body has been moved to Lee Funeral Home.

The shooting happened on Thursday, June 13, 2024 afternoon at Makadara Law Court after Magistrate Kivuti revoked the bond of an accused person who had repeatedly failed to appear in court.

Chief Inspector Samson Kipchirchir Kipruto, upset by the decision affecting his wife, drew a gun and shot the magistrate, hitting her in the chest and hip.

Kipruto was then shot and killed by other officers present. The attack also injured three other officers.

In response, the Judiciary has suspended operations at Makadara Law Courts and started providing psycho-social counselling for its officers and staff.

Chief Registrar Winfridah Mokaya met with judicial officers to discuss the incident and support them through a counseling session led by Rose Ngondi from Chiromo Hospital.

Chief Magistrate Tito Gesora and other magistrates urged the Judiciary to enhance security measures for judicial officers.
