Mutyambai ordered to reinstate Oscar Sudi security detail

A Nakuru court has ordered the Inspector-General of Police (IG) Hillary Mutyambai to reinstate security detail for Kapseret MP Oscar Sudi.

Nakuru Senior Resident Magistrate Isaac Orenge said the action to withdraw Sudi’s security was illegal and unconstitutional. 

In his ruling, the magistrate observed that the process was marred with illegalities and was not done in accordance with the law. 

While ordering that his security be reinstated without fail, the magistrate noted that Sudi had already been condemned unheard. 

Sudi had on Tuesday filed an application seeking court orders to suspend the decision by the government to withdraw his personal security.  

Through his lawyer Kipkoech Ng’etich, the legislator questioned the legal foundation of the move by the IG to remove his security.  

Sudi claimed his personal detail was withdrawn immediately after his arraignment for hate speech and offensive conduct.  

According to Kipkoech his client’s security detail received verbal communication to report back to his work station without further explanation.  

Kipkoech termed the move as ill-motivated and meant to expose his client to insecurity and disfranchise his services to his electorate.  

Further, he wants the court to order Mutyambai to reinstate Sudi’s security pending hearing and determination of the application or in turn summon the IG to explain why he made the decision. 

The IG had on January 20, through the Director of Corporate Communications, pronounced that the National Police Service (NPS) shall not provide security to VIPs who are involved or suspected to be involved in crime until they are cleared by the courts. 

Sudi is expected back in court on October 30 for the hearing of his hate speech case.
