Lawyer Ndegwa Njiru has set a condition that must be met before Kenyans allow the arrest of former Deputy President and the Democracy for Citizens’ Party Leader Rigathi Gachagua.

Speaking to Kameme TV on Tuesday, August 19, 2025, Ndegwa Njiru waded into the heated remarks on terror links by Gachagua while in the US.

An arrest must be justified

Njiru said there was a legitimate question that needed to be answered before any arrest was carried out.

“That is why I am saying this, those saying they will arrest Gachagua upon his return, they can proceed if they want, but the legitimate question must be answered.

“Will you arrest CS Murkomen, who authorised the negotiation between the government and the Alshabaab?” he posed.

He further pointed out that responsibility does not end with the Cabinet Secretary alone.

“Number 2, is it Murkomen who permitted the negotiation of Murkomen as a CS, or is it his master, William Ruto, who sent him?” Njiru argued.

Whistleblower protection invoked

The lawyer went on to frame Gachagua’s controversial remarks as an act of whistleblowing rather than treason or security risk.

“Thirdly, when the abducted chiefs from Mandera were released from Alshabaab, does that amount to admission that the government is in contact with Alshabaab militia.

“Was Rigathi wrong? Is Rigathi Gachagua not a whistleblower and not protected under the whistleblower protection act?”

According to Njiru, the priority should be identifying the true source of the problem rather than punishing the messenger.

“Who should be arrested? The whistleblower, the potential threat or the person who perpetrated the act? Between Rigathi and Murkomen, who is a robber?” he pressed.

Njiru’s remarks come at a time when political temperatures remain high, following growing divisions within the ruling camp and renewed scrutiny over the handling of national security matters.

Gachagua’s statements abroad have sparked fierce reactions from both allies and opponents, with some calling for his immediate arrest while others defend him as raising uncomfortable truths.

By insisting on whistleblower protection and shifting focus to top government figures, Njiru has reignited the debate on accountability, transparency, and the role of opposition voices in safeguarding national interests.
