Justina Wamae: Court ruling vindicates my rejection of Ruto’s job offer

Former Roots Party presidential running mate Justina Wamae has said she was right to reject a job offer from President William Ruto, after the High Court ruled that the taskforce she was to serve in was unconstitutional.

In a statement shared on her official X account on Wednesday, July 23, 2025, Wamae said the court’s ruling confirmed that her earlier decision to decline the appointment was the right one all along.

She implied that the taskforce was not only unconstitutional but also part of a broader political scheme linked to national unrest.

“This settles it!” she declared. “That job that you always remind me that I was given and I refused was a larger scheme in managing the 25th June 2024 revolution. In short, it was fake!”

Wamae went on to point out that the courts had now validated her concerns.

“The court pronounced itself that it was unconstitutional… Are we together?”

Wamae’s renewed comments come after Justice Bahati Mwamuye of the High Court ruled in February 2025 that the taskforce was formed through an unconstitutional executive order. The judge annulled the taskforce and instructed the Ministry of Health to implement the already established Kenya Health Human Resource Advisory Council instead, within 30 days.

The court further barred the Ministry from continuing with the taskforce’s operations, stating that any report produced by the team would have no legal basis or credibility.

“I am satisfied that a 30-day stay would yield a report that would be the roots of a poisonous tree, especially after finding the taskforce to be unconstitutional,” Justice Mwamuye said in his ruling.

Wamae rejects state job

Wamae was appointed to the 20-member Presidential Taskforce on Human Resources for Health, established by President Ruto through Executive Order No. 5 of 2024 dated July 5, 2024. The taskforce was mandated to serve for six months and was to recommend ways of improving Kenya’s health workforce and address challenges in the health sector.

However, Wamae declined the appointment days later, citing personal reasons.

“After careful consideration, I have decided to decline your offer given that I’m currently on maternity leave and this development would affect my ability to work effectively at this time,” she said in a post on July 8, 2024.

She also thanked the president for the opportunity.

“Thank you, Mr President William Samoei Ruto, for recognising my strength, capacity, and ability and subsequently appointing me to serve in the presidential task force on addressing human resources for health vide gazette notice NO. 8437,” she wrote at the time.

The taskforce was chaired by Khama Rogo, with Judith Guserwa as the vice chairperson. Other members included Acting Director General at the Ministry of Health, Dr Patrick Amoth and KMPDU Deputy Secretary General Dr Dennis Miskellah.

Its core mandate was to identify legal, policy, administrative, and operational barriers affecting human resource performance in the health sector. It was also tasked with advising on the framework for employing 20,000 healthcare workers to meet World Health Organisation recommendations.
