A 76-year-old man identified as Evanson Kibutu Mungai has been charged for among other counts, indecently assaulting a school-going girl by touching her private parts.
The man who went into hiding abroad after committing the crime was yesterday arraigned in court – virtually.
In another count, he was also alleged to have defiled the 16-year-old girl, an act that allegedly led to the girl’s pregnancy and eventual birth of a baby who is currently three months old.
He, however, denied the two charges, before Kikuyu resident magistrate G Onsarigo while at King’eero police station.
“I have given the investigating officer 14 days to submit all the exhibit and witnesses in these cases before the mentioned date,” Onsarigo ordered.
It was alleged that he committed the offence at Kibiku village in Gathiga sub-location in Kabete sub-county between March 1 and June 20, 2020.
The prosecution told the magistrate that they have not finished their investigations, as they were waiting for DNA test results.
“We are not through with our investigations including the DNA results that will of great importance in this case, and therefore we are pleading with this court to give 14 days,” the prosecutor explained.
However, the suspect asked the court to supply him with copies of the witness’s statements and any other document the prosecution wishes to use as an exhibit.
Mungai also pleaded with the court to set him an affordable bond saying he was not feeling well. When he was arrested on June 16, police had to release him on a Ksh50,000 bond, since he was not feeling well.
The court released him on a bond of Ksh 300,000 or a surety of the same amount or a cash bail of Ksh 100,000 setting the case to be mentioned on July 7 so that police can report the progress, and the hearing date will be set.
