A 45-year-old man has been sentenced to 50 years in jail for subjecting his eight-year-old nephew to a series of sexual assaults.
While pronouncing the sentence, Malindi Senior Principal Magistrate Olga Onalo found that Said Kashuru Baya was a notorious predatory paedophile, who lured his nephew to his room to perform the beastly act and later buy his silence with Ksh10.
“A- 45-year-old paedophile who subjected his 8-year-old nephew to a series of sexual assaults has been sentenced to 50 years in prison. Malindi Senior Principal Magistrate Hon. Olga Onalo today convicted and sentenced Said Kashuru Baya after finding him guilty of incest. Hon. Onalo heard that Baya was a notorious predatory paedophile, who lured his nephew to his room to perform the beastly act and later buy his silence with Ksh10,” the Office of the Directorate of Public Prosecutions (ODPP) stated.
The judge ruled that the acts tortured the minor psychologically, emotionally and physically.
“The magistrate stated that the prosecution through Suke Summaru discharged its responsibility of proving the case beyond any reasonable doubt,” ODPP added.
Five witnesses including the minor testified and the court observed that evidence incriminated the accused.
The ODPP asked the court to consider the severity of the act on the minor’s future life in general.
According to revelations by the ODPP, the minor, who suffered extensive injuries and trauma, testified that his uncle severely sexually abused him after luring him to his room.
ODPP said the accused threatened to kill the boy should he dare to reveal anything to his parents or siblings and every time the accused would perform such an act, he would give the minor Ksh10 presumably to buy his silence.
“However, the sex pest’s fate was sealed when the minor’s father overheard the victim’s elder brother telling his younger brother, “nenda kwa mjomba Said Kashuru Baya akufanyie tabia mbaya ili akupe Ksh 10 (Go to Uncle Said Kashuru and perform bad manners so her can give you Ksh10)”,” ODPP revealed.
The minor opened up after his distraught father reprimanded the two boys to shed more light over what they were conversing about.
“The man alerted his wife, the children’s mother, who also revealed some strange habits in her son including difficulties in walking and call of nature,” ODPP added.
Members of the public arrested the convict after words spread in the village and took him to Gongoni police station. He was later charged with incest.
“The accused committed the offence on diverse dates in November 2022 at Pumwani Village in Magarini sub-county, Kilifi County,” ODPP added.
