Former Sports PS Kaberia and 8 others charged in Ksh330.5M CHAN graft case

Former sports principal secretary and ex-ambassador Peter Kirimi Kaberia and eight others have been charged with conspiracy to commit an economic crime.
Kaberia, Stephen Njoroge Muthuma, Enock Onditi Ondwari, John Kiende Ruga, Samuel Mbaa Njoroge and three companies have been charged with misappropriation of Ksh330.573,997.52 million allocated for hosting the 2018 African Nations Championship (CHAN).
According to the charges, the accused persons conspired to commit the offence while they worked as the officers of the Ministry of Sports, Culture and Arts State Department for Sports, a senior superintendent engineer at Sports Kenya, between January 23, 2017, and January 19, 2018.
Further, the prosecution state that the said public funds were advance payments to Auditel Kenya Limited for the supply, testing, commissioning and supervision of security access control, communication, audio-visual and ICT lighting systems for the five stadiums selected to host CHAN 2018.
Ex-PS Kaberia has also been charged with abuse of office for improperly using his office to grant a tender of Ksh330.5 million to Auditel Kenya Limited on September 14, 2017 without following the required procedure.
“Being the Principal Secretary at the Ministry of Sports, Culture and the Arts, the State Department for Sports used your office to improperly confer a benefit of USD3,154,322.40 (Ksh 330,573,997.50) to Auditel Kenya, being advance payment for the tender No. MOSCA/CHAN/001/2017-2018, by signing the contract for design, supply, testing, commissioning and supervision of security, access control, communications, audio-visual and pitch lighting systems dated September 14, 2017, between the Ministry of Sports, Culture and the Arts, the State Department for Sports and M/S. Auditel Kenya without undertaking a procurement process as required by the Public Procurement and Disposal Act, 2015,” part of the charge sheet reads.
Denied all charges
Appearing before Milimani Senior Principal Magistrate Isabella Barasa on Tuesday, September 8, 2026, Kaberia, Muthuma, Onditi, Kiende, Mwangi, Samuel, and three companies (Leaspride Limited, Taxwise Africa Consulting LLP, and Liroma Assurance Services Limited) denied all the charges, and a plea of not guilty was entered.
Mwangi pleaded on his behalf and on behalf of Leaspride Limited, listed as the 13th accused person, and Samuel Mbaa Njoroge pleaded on his behalf and on behalf of Taxwise Africa Consulting LLP and Liroma Assurance Services Limited, listed as accused persons 15 and 16, which are companies.
The defence team, led by Assa Nyakundi, urged the court to release the accused persons on reasonable bail and bond terms.
Nyakundi told the court that the accused persons are respected Kenyan citizens who have served the country with distinction.
In addition, he informed the court that they all have fixed abodes and all are not flight risk.
“Your honour, we can assure you that the accused persons will attend court if granted bail,” lawyer Nyakundi told the court.
Notably, Lawyer Ndegwa Njiru told the court that the accused persons are victims of circumstances.
The prosecution did not object to the accused persons being released on bail and bond terms.
Freed on bail
Magistrate Barasa freed Kaberia, Muthuma, Onditi, Kiende, Mwangi, and Leaspride Limited in a bond of Ksh3 million each with an alternative of paying Ksh1 million cash bail.
Samuel Mbaa and his two companies, Taxwise Africa Consulting LLP and Liroma Assurance Services Limited, have been released on a bond of Ksh2 million with an alternative of paying Ksh600,000 cash bail.
The court has also ordered the accused persons to deposit their passports in court and also directed that they should not travel outside the jurisdiction of the court.
Magistrate Barasa has summoned Harun Chebet Komen, Marcos Gonzalez Puente, Auditel Kenya Limited, Muema Kitheka, Restea Enterprise Limited, Ephraim Muchangi Kinyua and Leasepath Limited to appear before her for plea taking.
The maths will be mentioned on September 15, 2026.
