Not going anywhere! Sifuna saved by Political Tribunal after ODM fired him in late-night purge

The Political Parties Disputes Tribunal (PPDT) has temporarily barred the National Executive Committee of the Orange Democratic Movement (ODM) from executing a resolution removing Nairobi Senator Edwin Sifuna as the party’s Secretary General.

Issuing the orders, acting PPDT Chairperson Gad Gathu on Thursday, February 12, 2026, also restrained the party from publishing in the Kenya Gazette the NEC resolution to remove Edwin Sifuna as the party’s Secretary General.

The conservatory orders will remain in force pending the hearing and determination of a notice of application filed by Sifuna challenging his removal as the party’s SG by the ODM NEC, which was made on Wednesday, February 11, 2026.

“That pending the hearing and determination of this instant application, inter partes, this Honourable Tribunal hereby issues orders staying the implementation of the resolution made by the National Executive Committee (NEC) of the Orange Democratic Movement Party (ODM) on February 11, 2026, to remove Edwin Sifuna as the Secretary General of the Party,” the acting PPDT Chairperson ordered.

“Pending the hearing and determination of this instant application, inter partes, this Honourable Tribunal hereby issues an order restraining the respondents (ODM and the Registrar of Political Parties) from publishing in the Kenya Gazette the resolution made on February 11, 2026, to remove Edwin Sifuna as the Secretary General of the Party,” the Tribunal added.

In his application, Sifuna argues that the said resolution was made without his removal being included as an agenda item of the meeting, adding that he was not notified of any complaint against him.

Further, he states that the party did not issue him with any notice to show cause or give him an opportunity to defend himself against the alleged misconduct.

Sifuna also argues that ODM moved swiftly to appoint his Deputy Secretary General as the Acting Secretary General and set a date for a National Delegates Convention.

“The ODM NEC’s resolution was made in breach of the provisions of Article 74 of the ODM Constitution, Section 4 of the Fair Administrative Action Act, Cap 7L Laws of Kenya, and Article 47 of the Constitution,” Sifuna adds.

The matter will be mentioned on February 26, 2026, at 2:30 pm for further directions.
