Investigator tells court no marks or signs of force on window Jeff Mwathi fell from

Chief Inspector Mureithi has told the court that there were no marks or pieces of clothes left at the window grill through which the late Jeff Mwathi is said to have jumped.

Appearing before the Milimani Principal Magistrate Rose Ndombi, Officer Mureithi, attached to Kasarani Police Station, also told the court that there was no indication of force applied to the window grills.

In his testimony before the court on Monday, May 11, 2026, the officer informed the court that even though the window had grills, a human being could possibly pass through the gaps.

However, the crime scene investigator noted that not all could pass through the gaps, but it depended on the size of the person’s body.

“Your honour, from a human point of view, a human can pass through the gaps, but it depends on the size of the body,” Officer Mureithi told the court.

The court heard that the open window had five gaps which were of the same size.

Notably, the officer told the court he unfortunately cannot tell which gap the deceased is said to have passed through.

“Unfortunately, my lady, I cannot tell which gap he (the deceased Jeff Mwathi) jumped through,” Officer Mureithi stated.

During today’s hearing, it was also revealed that the photos of the crime scene do not indicate the time and date stamps at which they were captured.

The defence team asked Officer Mureithi why the photos had no time or date stamp.

Pressed hard to explain to the court why the photos did not have the stamps, which, according to the defence team, were very important for the details, Mureithi said they are not necessary.

“Your honour, the time stamp and date stamps are not necessary,” the officer told the court.

The court heard that it can only rely on the certificate officer Mureithi produced after he documented the crime scene.
