Court summons lawyer Stephen Ogolla in Sonko graft case

A Nairobi court has ordered lawyer Stephen Ogolla to appear before it and tender his evidence in the former Nairobi County Governor Mike Mbuvi Sonko’s graft case hearing.
Milimani Anti-Corruption Principal Magistrate Charles Ondieki on Tuesday, February 3, 2026, summoned lawyer Ogolla to appear before him on Wednesday, February 4, 2026.
The summons came after the defence legal team made an oral application seeking court orders to have the lawyer appear as a defence witness in the case.
According to Sonko’s lawyers, Ogolla holds crucial evidence that is needed in that case, and there is a need for him to tender it in during the ongoing defence hearing.
“Your honour, I wish to make an application for issuance of summons to witness Stephen Ogolla, who is a counsel and needs to issue crucial evidence in these proceedings,” the defence submitted to court.

Further, the court heard that lawyer Ogolla will be needed to produce three crucial documents pertaining to the case.
According to the defence, the lawyer needs to present to court three different charge sheets.

“I am instructed by the first accused person (Sonko) that counsel Stephen Ogolla is supposed to produce a charge sheet before the complainant is charged with the first accused person. The second is also a charge sheet after the complainant was removed from the charge sheet, and there is also another one in which the complainant was charged in an NHIF case,” the defence team submitted to court.
Notably, the defence told the court that the three documents in their application are supported by facts and points of law and that it is in the interest of justice that he be summoned to testify.
In addition, they noted that his testimony will assist the honourable court in arriving at a just determination of the case, noting that there will be no prejudice occasioned to the prosecution by the issuance of summons to the defence witness.
The Directorate of Public Prosecution (DPP) did not oppose the request for summons; however, the prosecutor informed the court that the documents mentioned by the defence that Ogolla is supposed to produce in court have not been supplied to them.
