Ex-MP Sammy Mwaita, Shaba Trustees Limited director charged with Nairobi West land fraud

The Director of Shaba Trustees Limited, Brian Kiptoo Kiplagat, has been charged with three charges that include prime parcels in Nairobi West worth Ksh300 million.
Appearing before Milimani Principal Magistrate Benmark Ekhubi on Tuesday, August 5, 2025, Kiplagat denied all three charges against him.
According to the charge sheet, Kiplagat, together with former Baringo Central Member of Parliament Sammy Mwita, conspired to commit a felony contrary to section 393 of the Penal Code, chapter 63, Laws of Kenya.
“On or before March 30, 2001, within Nairobi County, conspired to commit a felony, namely, making a document without authority with grant title land reference No. 209/9968 IR. No. 85847 with intent to defraud Rose Njoki King’au of a parcel of land known as Plot No. A Nairobi West, off Lang’ata Road, measuring approximately 0.12 hectares, situated along Mai Mahiu Road off Lang’ata Road in Nairobi West, valued at Ksh150 million,” part of the charge sheet read.
In the second count, Kiplagat has been charged with conspiring with the former Commissioner of Lands and former Baringo Central MP Mwaita to commit a felony, namely, making a document without authority.
The charge sheet states that the two made a document with grant title land reference No. 209/9968 IR No. 85847 with intent to defraud Micugu Wagatharia of a parcel of land known as Plot No. A Nairobi West, off Lang’ata Road, measuring approximately 0.12 hectares, situated along Mai Mahiu Road off Lang’ata Road in Nairobi West, valued at Ksh150 million.
Kiplagat was also charged with giving false information to a person employed in the public service contrary to section 129(a) of the Penal Code, chapter 63, laws of Kenya.
According to the prosecution, the accused said that on March 18, 2020, while at the Directorate of Criminal Investigations (DCI) Headquarters at Mazingira Complex along Kiambu Road, he knowingly gave false information to Sergeant Nicolaus Osuri Otieno.
In addition, the prosecution states that Kiplagat told the officer that the parcels of land known as Plot Nos ‘A’ and ‘B’ in Nairobi West off Lang’ata Road, now registered as land reference No. 209/9968 IR. No. 85847, situated along Mai Mahiu Road, belongs to Shaba Trustees Limited; information he knew was a lie.
After denying the charges, the court released Kiplagat on a bond of Ksh5 million and a cash bail of Ksh1 million.
“The accused has been released on a Ksh5 million bond with surety of the same or an alternative cash bail of Ksh1 million and must provide two contact persons,” Magistrate Ekhubi ruled.
Kiplagat has been charged alongside Mwaita, who on Monday, August 4, 2025, denied six charges that involve land fraud in Nairobi West.
The other counts that he was charged with include abuse of office, making a document without authority, conspiracy to commit a felony, and giving false information to a public officer.
The matter will be mentioned on September 9, 2025.
