Ndiangui: I was not abducted, fear of torture and murder made me hide

Blogger and IT expert Ndiangui Kinyagia has told the court that he was not abducted, but he decided to go into hiding for fear of being abducted, tortured, and killed.
Kinyagia’s lawyer, Senior Counsel Martha Karua, informed the court on Tuesday, September 16, 2025, that the blogger, through an affidavit dated August 5, 2025, explains the circumstances that drove him into hiding incommunicado.

According to Ndiangui, while he was out of his house for an errand, he learnt that the police had opened his house without his permission, searched it, and changed the locks.
That prompted him to run for his life without communicating to anyone, including his mother, about what was happening, since he also left his phone for fear of being traced through it.
Further, he reveals that he did not know that there was a case in court, adding that he came out of his hiding due to poor living conditions.
He then bought a phone to call his cousin, and that is when he learnt of the case and presented himself to court.

In his affidavit, Ndiangui states that he really fought the urge to come out of his hiding due to the fear of the reported previous cases of abductions, torture, and killings.
“I contemplated going back, but I feared likely abduction, torture, killing, or disappearance and went into hiding to preserve my life,” Ndiangui states in his affidavit.
In his ruling, Justice Chacha Mwita stated that the court has taken into account what led to Ndiangui’s disappearance and that he went into hiding for fear of his life.
He also noted that the court has seen the affidavit sworn by his mother on the circumstances that led her to instruct the Law Society of Kenya to take up the matter on behalf of her family.
“The second petitioner (LSK) acted under instructions given to them by the second petitioner’s mother (Ndiangui’s mother) or his family, who reached out to them for assistance due to the distress she was going through after her son went missing,” Justice Mwita stated.
Notably, he has stated that no offence can be attributed to LSK given the threats that have been going on recently.
Ndiangui presented himself in court after Justice Mwita had ordered the Directorate of Criminal Investigations (DCI) boss, Mohamed Amin, to present the blogger in court dead or alive.
Justice Mwita has closed the file and wished the IT expert well.
