A Busia man has been arraigned at the Milimani Law Courts and charged with conspiring to defraud the Social Health Authority (SHA) of Ksh5,128,400.

Markdhillion Sydon Mutsotso, a supervisor at St Mark Orthodox Health Centre in Chavakali, has been charged with conspiracy to defraud, contrary to section 317 of the Penal Code.

According to the charge sheet, Mutsotso, with others who were not in court on Monday, October 6, 2025, conspired to defraud SHA through the Health Centre between October 2024 and June 2025.

“On diverse dates between October 2024 and June 2025, at St Mark Orthodox Health Centre Limited in Chavakali within Vihiga County, with intent to defraud, jointly with others not before court, conspired to defraud the Social Health Authority of a sum of Ksh5,128,400,” part of the charge sheet read.

On another count, Mutsotso and Fenley Ngairah Desounza, who was not in court, have been charged with falsification of patients’ health documents contrary to section 48(3) of the Social Health Insurance Act.

According to the prosecution, the two, between October 1, 2024, and June 30, 2025, knowingly and fraudulently falsified information on medical claim forms and medical documents by inserting patients’ details in order to misrepresent that the patients had undergone treatment with the intention to defraud SHA and obtain benefits not lawfully due under the Social Health Insurance Act.

Appearing before Milimani Chief Magistrate Lucas Onyina, Mutsotso pleaded not guilty to the two charges lodged against him by the Directorate of Public Prosecution (DPP).

Further, he urged the court to release him on reasonable bail, arguing that he is a young employee earning a monthly salary of Ksh40,000.

He also told the court that he is not a flight risk and has a fixed abode.

The prosecution did not oppose his release on bail but urged the court to impose strict and tough bail conditions.

“The prosecution has no objection to the accused being released on bail, but we urge the court to bear in mind the seriousness of the charges against the accused and impose tough bail terms,” the prosecution told the court.

Magistrate Onyina released the accused on a Ksh200,000 bond with one surety of a similar amount or, alternatively, to pay Ksh70,000 cash bail.

Notably, the court issued warrants of arrest against the first and third accused (Fenley Desounza and Sammy), who were not in court for plea taking.

The matter will be mentioned on October 21, 2025, for further directions.
