Former Baringo Central MP Sammy Mwaita denies land fraud charges

Former Commissioner of Lands and former Baringo Central Member of Parliament Sammy Silas Komen Mwaita has on Monday, August 4, 2025, denied six charges that involve land fraud in Nairobi West.

The Directorate of Public Prosecution (DPP) charged the former MP with land fraud scheme that involves two prime parcels in Nairobi West worth Ksh300 million.

The other counts he was charged with include abuse of office, making a document without authority, conspiracy to commit a felony, and giving false information to a public officer.

Appearing before Milimani Principal Magistrate BenMark Ekhubi, Mwaita pleaded not guilty to the six counts and a plea of not guilty was entered.

According to the charge sheet, on or before March 30, 2001, Mwaita is accused of conspiring with Brian Kiptoo Kiplagat to fraudulently make a grant title, without lawful authority, with the intent to defraud two Nairobi businesspersons, Rose Njoki King’au and Micugu Wagatharia.

It also states that the two targeted two plots located off Lang’ata Road along Mai Mahiu Road, each measuring approximately 0.12 hectares, costing Ksh150 million each.

“On or before March 30, 2001, at the Ministry of Lands and Physical Planning within Nairobi County, being the Commissioner of Lands, (Mwaita) caused to be made fraudulent registration of grant title deed Land Reference Number 209/9968 for a parcel of land known as Plot No. ‘A’, Nairobi West, off Lang’ata Road without the consent of the rightful owner, Rose Njoki King’au, in abuse of the authority of his office,” part of the charge sheet read.

The accused is also said to have made a false Certificate of Title for both plots “without lawful authority or excuse” in the name of Shaba Trustees Limited, purporting it to be a legitimate document issued by the Ministry of Lands.

The prosecution further states that on March 17, 2020, Mwaita misled a Directorate of Criminal Investigation (DCI) officer, Sergeant Nicolaus Osuri Otieno, that the disputed parcels belonged to Shaba Trustees Limited, information he knew to be false.

Kiplagat also faces a similar count of giving false information to police on March 18, 2020, at the DCI Headquarters at Mazingira Complex, Kiambu Road.

Magistrate Ekhubi issued a summons against Kiplagat Kiptoo to appear before him on Tuesday, August 5, 2025, after he failed to turn up for plea taking.

Mwaita, through his lawyer, urged the court to grant him reasonable bond terms, saying he was not a flight risk and had cooperated with investigators throughout the probe.

However, the DPP did not oppose his release on bail but requested the court to issue strict orders considering the cost of the land parcels.

Magistrate Ekhubi released Mwaita on a bond of Ksh10 million or a cash bail of Ksh2 million, with two contact persons.
