Court slaps man with death sentence for robbery with violence

Tamu Law Courts Senior Principal Magistrate Amos Mokoross has handed a man a death sentence for the offence of robbery with violence.
In a statement seen on June 14, 2024, the suspect Kevin Onyango, was armed when he robbed James Kamau in an offence committed in Kisumu in 2023.
Kevin was charged with two counts of robbery with violence contrary to section 296(2) of the Penal Code and stupefying in order to commit a felony contrary to section 230 of the Penal Code.
“On the first count, the accused Kevin Onyango Kiyogo while armed with dangerous weapons using actual violence robbed James Kamau of his motor vehicle Toyota Hillux valued at Ksh 1, 800,000,” ODPP’s statement read in part.
On the other hand, Kevin was charged with administering an overpowering drug to James Kamau.
“The offences were committed on June 23, 2023, at Kogutu area of Muhoroni sub-county in Kisumu County,” ODPP added.

Prosecution on death sentence
Further, through testimonies and witnesses who appeared in court, the prosecution was in agreement with all tabled exhibits concluding that Kevin and others who were not in court committed the offence.
“The prosecution through Ms. Beatrice Langat presented evidence through testimonies of 8 prosecution witnesses which the court agreed with noting that all exhibits and testimonies drove to the conclusion that the accused person jointly with others not before the court indeed committed the offence on the complainant,”
According to the the magistrate, he sentenced Kevin on two counts, in the first count it was because of robbery with violence and in the second count because of administering an overpowering drug to Kamau.
“In his judgement, the magistrate sentenced the accused person in the first count of robbery with violence to serve a death sentence and in the second count of administering an overpowering drug to the complainant, the accused person will serve five years imprisonment,” ODPP’s statement read in part.
Furthermore, it was noted that the death sentence will be held in abeyance until the completion of the five-year sentence.
