Court defers plea taking for 3 linked with Ksh350M NSSF land fraud

A Nairobi court has deferred the plea taking of three men linked with defrauding the National Social Security Fund (NSSF) of a parcel of land measuring approximately 3,043 hectares located within Mavoko municipality valued at approximately 350,000,000.

According to the charge sheet, the three, Harish Ramji Manji, Ashvin Ramji Manji and Bharat Ramji Manji, on May 27, 2010, are said to have conspired in forging a transfer document of the said land, purporting it to be a genuine transfer document signed by the Board of Trustees of the NSSF, a fact they knew was false.

However, appearing before Milimani Chief Magistrate Dolphiona Alego on Friday, December 5, 2025, defence counsel led by Ndegwa Njiru objected to their clients pleading to the charges, informing the court that the same matter is before another court.

“Your Honour, a matter that you are currently handling is being handled by another court of competent jurisdiction,” lawyer Njiru told the court.

Further, he accused the Directorate of Public Prosecution (DPP) of not disclosing to the court the fact that the particulars in the charge sheet presented before Magistrate Alego are the same particulars in the charge sheet before Senior Principal Magistrate Ben Mark Ekhubi.

Notably, they informed the court that there was a stay order from the Court of Appeal relating to all facts in the charge sheet before the court, a fact that the State Counsel Victor Owiti conceded.

The defence urged the court to grant their clients a personal bond and defer the plea taking to Monday, December 8, 2025, for the court to confirm the matter is not sub judice.

Magistrate Alego released each of them on a personal bond of Ksh200,000, with each having a contact person, and directed the prosecution and defence counsels to present the charge sheet before Magistrate Ekhubi before her on Monday, December 8, 2025.

“I will give a personal bond of Ksh 200,000 plus a contact person for each of the accused persons. Both parties, that is, the defence and the prosecution, availed the charge sheet mentioned and the citations in the case before my brother, Honourable Ben Mark, on Monday; these are the orders of the court,” Magistrate Alego ruled.

The matter will be mentioned on Monday, December 8, 2025, for further directions.
