Court issues arrest warrant for lawyer Guy Spencer Elms over forgery charges

A Nairobi Magistrate’s Court has issued a warrant of arrest against lawyer Guy Spencer Elms for failing to appear in court to answer to multiple forgery-related charges.

Principal Magistrate Ben Mark Ekubi issued the warrant following an application by the prosecution, which informed the court that the accused had disobeyed a lawful court summons.

“I hereby issue a warrant of arrest against the accused person to be brought to court on August 11th to take a plea,” Ekubi ruled.

The accused’s lawyer had pleaded with the court for more time, claiming his client was attending to a sick child. He further informed the court that Elms had booked return tickets to travel back into the country to appear in court as required.

Despite this, the court proceeded to issue the arrest warrant, noting that there was no justification for his failure to attend.

According to the charge sheet filed in court, Guy Spencer Elms is facing five counts relating to forgery, including making false documents, uttering false documents, and attempting to fraudulently acquire property.

Details of the Charges

Count I – Making a False Document: The prosecution alleges that on or before March 24, 1997, at an unknown location within Kenya, Elms, with intent to defraud and without authority, made a false document — a will dated March 24, 1997—purporting it to be a genuine will signed by the late Roger Bryan Robson.

Count II – Uttering a False Document: It is alleged that on February 10, 2015, at the Directorate of Criminal Investigations (DCI) Headquarters in Nairobi, Elms knowingly and fraudulently uttered the said forged will to Corporal Samuel Kamau, presenting it as a genuine will of the late Robson.

Count III – Making a False Power of Attorney: On or before January 28, 2010, Elms is alleged to have made a forged Power of Attorney dated January 24, 2010, again purporting it to be signed by the late Robson.

Count IV – Uttering a False Power of Attorney: On the same date of February 10, 2015, Elms allegedly presented the forged Power of Attorney to the same DCI officer, Corporal Kamau.

Count V – Demanding Property Upon Forgery: The prosecution further claims that on October 30, 2013, at the High Court in Nairobi, Elms attempted to fraudulently acquire two parcels of land, LR No. 2327/10 and LR No. 2327/117 in Karen — valued at Ksh 100 million — by virtue of a grant of probate obtained through a forged will filed in Succession Cause No. 955 of 2013, involving the estate of the late Roger Bryan Robson.

The matter will be mentioned again on August 11, 2025, when Elms is expected to appear in court to take a plea.
