Court gives directions on petition to halt Ruto’s State House church project

A Nairobi High Court has set July 24, 2025, for directions for a petition filed seeking to block President William Ruto from building a State House mega church.
Justice Lawrence Mugambi has, on Monday, July 7, 2025, directed the petitioner, Levi Munyeri, to serve the notice of motion application and the petition physically to the Attorney General, within the next three days.
Further, Justice Mugambi has directed the Attorney General, Dorcas Oduor, to file responses to both the application and the petition within seven days from the date of service.
Munyeri, through a notice of motion that is listed as extremely urgent, is seeking a court order halting the construction of the Nairobi State House mega church, pending the hearing and determination of the petition filed.
“This honourable court be pleased to issue a conservatory stopping any continued construction or impending construction of a mega church at State House, Nairobi, pending hearing and determination of this application inter partes,” part of the notice of motion read.
The petitioner further seeks a conservatory order stopping any use or continued use of public funds in the construction or impending construction of the mega church at Nairobi State House pending the hearing and determination of the petition.
According to Munyeri, the construction of the said church in public land using resources of a private citizen undermines well-established constitutional provisions of no state religion, national values of public participation, transparency, rule of law, equality, and non-discrimination.
“That the megachurch is under construction without any public participation or approval by Parliament to allow such kind of monumental development on public land, the structure of the mega church is already taking shape and can be seen in satellite images rising near the presidential helipad at the State House Complex,” part of the notice of motion read.
Notably, the petition states that the construction of the said church grossly undermines the constitutional provisions that denounce any state religion and affirm the hallowed doctrine of the separation of church and state.
The petitioner notes that if the construction of that church is allowed to continue, there is an imminent risk of the Constitutional dictates on religion and the rise of religious tension in the country.
On July 4, 2025, President William Ruto admitted that he was constructing a mega church at the State House Complex in Nairobi.
