Nairobi Chief Magistrate Court has ordered verification of a medical document presented by an accused person charged with forging letters to transfer ksh3.8 billion belonging to a limited company.
Senior Principal Magistrate Martha Nazushi said a document presented to court by Isaac Opondo through his lawyer has been questioned by the complainant’s counsel Danstan Omari as to whether the document originates from Aga Khan hospital to ascertain if the accused was indeed sick.
“I kindly request that the document presented to this court from Aga Khan be verified for the satisfaction of Counsel Omari,” Senior Principal Magistrate asked Isaac Opondo’s lawyer.
Omari told the court that the accused has been evading trial and that the matter has been pending in court for long.
He urged the court to cancel bail or bond terms issued to the accused person so he can be placed under the jurisdiction of the court to enable the matter to proceed.
“The accused’s bail should be cancelled for the reason that he has been intentionally evading this trial,” Omari said.
Omari submitted that the complainant Beatrice Auma who resides in Canada has since given her evidence and it is only two witnesses; investigating officer and document examiner who are to adduce their evidence.
The court directed the case to proceed on August 3 and the verification report be filed.
The accused Opondo is charged that on February 5, 2016, with intent to defraud, he forged a document namely an affidavit purporting to have been signed by Auma indicating she had resigned from Neutronics Communication limited a fact he knew was false.
