Judge quashes order compelling Babu Owino to pay DJ Evolve’s hospital bill

High Court judge Luka Kimaru has reduced by half Embakasi East MP Babu Owino’s cash bail to Sh5 million.

On Tuesday, the judge also quashed Magistrate’s Court order compelling Babu Owino to pay the hospital bill of the man he is accused of shooting —Felix Orinda alias DJ Evolve.

According to the judge, the order to pay the hospital bill can only be given by a civil court and not a criminal one.

Justice Kimaru ruled that Babu Owino can only pay the hospital bill as a moral obligation and not based on a court order.

“The accused person should continue paying the hospital bill as a moral duty to him, not as a court order. If he fails to pay is up to him and his God,” Justice Kimaru ruled.

The judge halved Babu Owino’s cash bail from Sh10 million to Sh5 million and the MP now only has to deposit Sh600,000 as he had already paid Sh4.4 million.

After reducing his cash bail, the court had Babu Owino remanded until he pays the remaining Sh600,000 .

His case will be mentioned on March 20, 2020.
