Four cops in court over Ksh1M bribe

Three police officers attached to the DCI-Dagoretti were arraigned at the Anti-Corruption Court with conspiracy to corruptly receive a bribe of Ksh1 million from a Chinese investor.

The officers namely Charles Macharia Wanjiru, Samuel Yunnah Kukhuvilo, Joseph Gikara Gachera and the main suspect Julius Onyango Oguma in absentia did not plead to the graft charges filed against them.

However, Senior Principal Magistrate Victor Wakumile ordered the police officer Onyango who skipped court attendant to present himself on March 22 for plea taking.

While deffering the plea, the magistrate allowed the suspects to engage lawyers and to avoid dealing with the case haphazardly.

“I allow the defence to put their house in order and a summon to be issued against Julius Onyango Oguma. Plea deferred to March 22, 2022, at 9 AM,” Wakumile ordered.

The prosecution says the four officers, in a dramatic arrest, fired in the air in a bid to obstruct EACC officers from executing the arrest.

It is said that the three who were present in court stormed the scene in Kabete police station and fired several rounds of ammunition, scaring the EACC officers and aiding the escape of one of the police officers Julius Onyango.

In the Melee, EACC officers claim that Onyango escaped with a Ksh100,000 bribe while handcuffed.

According to a charge sheet filed in court, the four officers are facing eight charges of conspiracy to commit an economic crime, receiving a bribe, obstruction, aiding a prisoner to escape and Robbery with violence.

The officers are charged with receiving a bribe of Ksh 1 million from Pan Xido Yan not to charge his wife Gong Huan with an offence of being in Kenya without valid immigration documents.

The alleged offences were committed on November 28, 2018.

In the second count, Onyango is accused of receiving a bribe of Ksh200,000 from Jane Wangu an employee of Yan as an inducement not to charge Gong.

In another count, the four officers were accused of obstructing the EACC officers namely James Wachira, Martin Mbuvi, Philip Major and Alex Nyakundi from arresting them at Kabete police station by drawing their firearms and shooting in the air to scare them away.

Macharia, Yunnah and Kigara are facing a charge of aiding Onyango to escape from lawful custody.

Macharia is accused of violently robbing an EACC officer Philip Major Ksh7,000 and his job card.
