Court acquits rally driver Maxine Wahome in ex-lover Asad Khan’s death case
By Zipporah Ngwatu, July 28, 2026A Nairobi High Court has acquitted the World Rally Champion Maxine Wahome of murder charges against her deceased ex-lover and colleague, Asad Khan.
On Tuesday, July 28, 2026, Judge Lillian Mutende noted that the prosecution did not prove its case against the accused.
In the detailed ruling, Justice Mutende stated that the evidence adduced by the prosecution does not warrant the accused to be placed on defence.
The court noted that the prosecution strongly believed that there had been two people in the house; the one who was not in the house was guilty of the crime.
However, she avers that an inference that is not for the evidence to be produced excludes the inference of liability on the part of the one who was not in the house.
“In totality, other than that of all the evidence, just before the court the case presented by the prosecution has failed to establish a prima facie case warranting the accused person to be placed on defence, in the regard to which she is acquitted,” Judge Mutende ruled.
DNA report presented in court
According to the government analysis, the DNA profile generated from all the samples collected from broken glass, a blue T-shirt and a blue shirt matched the DNA profile generated from the blood marked as that of the assailant’s account of the deceased, but not Maxine’s.
Further, the court states that it is admitted by Dr Ndeba that the injuries sustained by the deceased could have been sustained when the deceased fell down the stairs.
In addition, the court notes that none of the witnesses testified to seeing the accused come out of the house until after the police arrived, and then she left the room.
During the proceedings, the prosecution questioned the conduct of the accused moving from the balcony area to the sitting room and locking the door from inside.
