MP Kibagendi charged with assault, released on bail

Kitutu Chache Member of Parliament (MP) Antony Kibagendi has been arraigned and charged before a Narok court with three different charges of bodily harm and malicious damage of property.
According to the charge sheet, the legislator has been charged with assaulting one Astarico Omariba Moriasi, leaving him with actual bodily harm, contrary to section 251 of the Penal Code.
The prosecution state that the MP, while in Kisii township on November 27, 2025, attacked Omariba while he was at Java House.
“On November 27, 2025, at around 0800 hours at Java House in Kisii township within Kisii County, [he] assaulted Astarico Omariba Moriasi, thereby occasioning him actual bodily harm,” the first count read.
On the second count, Kibagendi has been charged with malicious injury to property contrary to section 339(1) of the Penal Code.
The Directorate of Public Prosecution (DPP) states that on the same date and time, during the attack at Java House in Kisii township, they wilfully and unlawfully damaged Omariba’s phone, valued at Ksh230,000.
Further, the State has also charged him for maliciously, wilfully and unlawfully damaging Java House property listed as one brown chair, four plates and one cup, all valued at Ksh20,000.
Appearing before Narok Resident Magistrate Esther Mwikali Mutuku on Wednesday, January 21, 2026, MP Kibagendi denied all the charges, and a plea of not guilty was entered.
The court has freed the legislator on a Ksh100,000 cash bail.
His legal team, led by Kisii County Senator Okong’o Omogeni, also informed the court that he was earlier arrested and arraigned in a Kisii court, where he was granted a Ksh50,000 cash bail.
However, he was later re-arrested, prompting the transfer of the case from a Kisii court to a Narok court.
The court has set March 2, 2026, for the hearing.
