Judge gags Robert Alai and Fred Machoka from discussing their case on social media

A Nairobi High Court has cautioned Kileleshwa Member of County Assembly (MCA) Robert Alai and media personality Fred Machoka against discussing their ongoing case on social media until the conclusion of the matter.

Justice Stella Mutuku warned the parties in the suit on Monday, June 8, 2026, about giving opinions on the ongoing defamation case filed by Machoka against MCA Alai.

Judge Mutuku noted that her concern was about the opinions that are being given out when the matter is still before the court.

“The concern I am raising here is simple: the record of the court is open to scrutiny. What I am concerned about is I am not on social media and am not going to be there for the sake of this case,” Justice Mutuku stated.

She urged all parties to refrain from commenting on the matter and allow the court to conclude the proceedings before delivering its determination.

“Each of you prosecuted their case and defended it. Why don’t we let the process take its course to conclusion?” Judge Mutuku stated.

“Let’s not stop commenting about the case; let’s just wait. The court will finalise it, and then we can report the decision has been made,” Judge Mutuku directed.

Notably, the judge has warned lawyer Danstan Omari’s firm representing the media personality Machoka and that of advocate Oonge representing Alai to ensure that the matter is not discussed again on social media.

“Mine is to caution Mr Omari and anybody related to the firm and the client who is the plaintiff (Machoka), Mr Oonge and whoever is related to the defendant (Alai) to ensure that this is not repeated on social media,” Judge Mutuku ruled.

Appearing before Judge Mutuku, Machoka told the court that he saw YouTube video clips of what happened in court during the hearing of the matter.

He further informed the court that everything else that happened after that is putting him in a very difficult position.

“Your honour, the only thing I saw was a YouTube video clip of what transpired in court, but everything else that has happened after that is just putting me in a very difficult position. I have no explanation; just help me out, please,” Machoka submitted to the court.
