Man in court for distributing lady’s nude photos and videos via WhatsApp

Chrispus Mwinzi Peter on Thursday, April 3, 2025, pleaded not guilty to wrongfully sending obscene and intimate images and videos of Caroline Wavinya Musyimi to one Morris Kasii Muvua through WhatsApp.
Appearing before Milimani Law Courts Magistrate Carolyne Nyaguthii, Mwinzi denied all five charges against him.
According to the charge sheet, Mwinzi is accused of, on diverse dates between March 16, 2025, and March 31, 2025, at an unknown place within the Republic of Kenya, sending Wavinya’s nudes to Kasii Muvua contrary to Section 37 of the Computer Misuse and Cybercrimes Act No. 5 of 2018.
On the second count, Mwinzi is accused of cyber harassment for sending Wavinya’s nudes in an attempt to assassinate her character contrary to section 27(1)(b) as read with section 27(2) of the Computer Misuse and Cybercrimes Act No. 5 of 2018.
“On March 18, 2025, at an unknown time and place within the Republic of Kenya, the accused is said to have posted obscene, nude images of one Caroline Wavinya Musyimi that were calculated to demean her status,” part of the charges read.
Further, on the same date of March 18, 2025, Mwinzi is accused of posting obscene and nude videos of one Caroline Wavinya Musyimi with the aim of demeaning her status contrary to section 27 (1) (b) as read with section 27 (2) of the Computer Misuse and Cybercrime Act No. 5 of 2018.
The accused is also said to have sent Wavinya’s obscene videos to Kasii Muvua on March 25, 2025, which detrimentally affected him, contrary to section 27 (1) (b) as read with section 27 (2) of the Computer Misuse and Cybercrime Act No. 5 of 2018.
On the fifth count, Mwinzi is accused of sending obscene nude images to Kasii Muvua that detrimentally affected him.
Magistrate Nyaguthii released the accused on a bond of Ksh200,000 with a similar surety of the same amount or a cash bail of Ksh100,000 with two contact persons.
The matter will be mentioned on April 17, 2025, for further directions.
