Man charged with fraud tells court he has memory loss

A man accused of engaging in fraudulent acts has shocked the court after he informed the court that he is suffering from memory loss.

David Lunalo Shitsimi was arraigned at the Milimani Law Courts on Tuesday, November 11, 2025, after he was arrested following a warrant of arrest issued against him.

Lunalo was charged with five counts in 2021, where he pleaded not guilty to the charges and was released on bond.

However, he later stopped attending the court proceedings in 2022 and disappeared to an unknown place, prompting the state to request a warrant of arrest against him.

Appearing before Milimani Principal Magistrate Geoffrey Onsarigo, the prosecution informed the court that Lunalo was arrested at the Busia border as he was trying to flee.

“Your Honour, the accused was arrested as he attempted to leave the country at the Busia border,” the prosecutor told the court.

During the proceedings, Lunalo informed the court that he is suffering from loss of memory, adding that he has medical reports to prove his claim.

Further, he urged the court not to send him to remand prison but to police custody for two or three days, arguing that if he is sent to remand, he will not be able to organise to get the records to present to court.

“I’m only requesting your honour because I have records for my medical report, if you kindly allow me to be in police custody instead of remand so that I can be able to get the records, because if I’m put inside remand, it will be very hard for me to help myself. This is a humble plea, your honour. I thank God for this,” Lunalo told the court.

The accused also told the court that him being in police custody for the three days or even less will not interfere with the court proceedings or process.

Magistrate Onsarigo has ordered the accused to be remanded at the Industrial Area Prison until Monday, November 17, 2025.
