Court blocks Mwakideu, his sister Rozina from further publishing interview video touching on Burale
By Zipporah Ngwatu, October 28, 2025A Nairobi court has blocked journalist Alex Mwakideu and his sister Rozina Mwakideu from publishing the impugned interview video where Rozina states that her biggest mistake was marrying Pastor Robert Burale until the application in court is heard and determined.
Milimani Commercial Chief Magistrate Thomas Nzyoki on Tuesday, October 28, 2025, ruled that the duo should cease from publishing the video or anything in relation to the complained video on any social media platform.
“An order for interim injunction is granted to stay the defendants (Alex Mwakideu and Rozina Mwakideu) from any further publication of the complained video in any other social media platform pending hearing and pending hearing and determination of the application,” Magistrate Thomas Nzyoki.
However, the court has not granted an order Burale had sought to have Mwakideu pull down and delete each video containing parts of the content that he states has defamatory remarks against him until the application he has filed is heard and determined.
Magistrate Nzyoki stressed that his order is to block further publication but not to delete the video or the publications already done.
The defendant’s lawyer, Ochiel Dudley, has told the court that he will inform his clients to restrain from further publication of the video, as the court has ordered.
“Your Honour, as an officer of the court, I will inform my client not to publish anything in order to comply with your order,” lawyer Ochiel Dudley told the court.
Pastor Burale has sued journalist Alex and ex-wife Rozinah over defamatory statements through a YouTube video posted on Alex Mwakideu’s YouTube channel.
Through a certificate of urgency filed at the Milimani Commercial Magistrate Court on October 8, 2025, Burale sought a court order restraining Alex from publishing or making any statements against him pending the hearing and determination of his application.
“That pending the hearing and determination of this application inter partes, an order of injunction be granted restraining the respondent (Alex), whether by himself or his agents, from publishing and causing to be published any post or statements defamatory of the applicant (Burale) published on October 4, 2025, by any means inclusive of his YouTube channel under the name Alex Mwakideu,” part of the application read.
“That pending the hearing and determination of this application, an order of injunction be issued compelling the respondent (Alex Mwakideu), either by himself or his agents, to forthwith pull down and delete each post containing parts/intoto of the contents in the video https://.com/watch?v=UnVWMJWcj0u and of its related content,” Burale states in his application.
The celebrated pastor is also seeking a court order prohibiting social media users from sharing or posting the contents of the video containing defamatory allegations against him.
In his application, he wants the court to order his ex-wife, Rozina, and journalist Alex Mwakideu to offer a public apology to him that will be covered widely by media, including Alex Mwakideu’s YouTube channel.
“That pending the hearing and determination of this application and suit, an order of mandatory injunction be and is hereby legally granted compelling the respondents (Alex and Rozina) to offer an unqualified formal public apology with extensive media coverage inclusive of and not limited to the “Alex Mwakideu” YouTube channel,” part of Burale’s application read.
In addition, he wants the court to order the two to publicly withdraw and acknowledge the falsehood of the defamatory verbatim in the video and make an appeal to the public to cease sharing and any engagement of whatsoever nature with the referred content and any defamatory statement against him, including making a demand for complete expungement of the already downloaded video.
The matter shall be mentioned on February 25, 2026, to confirm the filing of submissions.
