ODPP issues security update after Makadara Law Courts shooting incident

Office of the Director of Public Prosecutions (ODPP) has issued a security update following a shooting incident at Makadara Law Courts that left a magistrate and other officers wounded.

In a statement issued on Friday, June 14, 2024, the ODPP assured all prosecution counsel based and working at the Makadara Law Courts of their safety and security within the premises.

The ODPP also extended the assurance to the members of the public who seek services at court stations.

“The Director of Public Prosecutions (DPP) is deeply saddened by the shooting incident which occurred at the Makadara Law Courts in Nairobi during an open court session on June 13, 2024.

“Further, the DPP assures all Prosecution Counsel based and working at the Makadara Law Courts and across all court stations in the country, plus members of the public who seek services at court stations, of their safety and security within the premises,” the statement reads in parts.

The ODPP also expressed disappointment in the fact that the incident had been caused by a police officer, who lost his life in the process.

“The incident left Principal Magistrate Hon. Monica Kivuti and other officers serving at the premises nursing gunshot wounds. It is unfortunate that this despicable act was caused by a police officer who lost his life. We condole with the officer’s family,” the ODPP said.

Eye opener

While wishing the injured officers a swift and complete recovery, the ODPP says the incident serves as an eye-opener to security organs to secure all court premises in the country.

“Accordingly, the DPP will join hands with the Judiciary and other members of the National Council on the Administration of Justice (NCAJ) to review security protocols within the court premises,” the office said.

The shooting incident

A magistrate at the Makadara Law Courts in Nairobi was on Thursday, June 13, 204, wounded after being shot by a police officer.

Magistrate Monica Kivuti was shot in the hip after she cancelled the bond of an accused person, who is the wife of the police officer, on grounds that she had jumped bond and failed to offer a satisfactory explanation.

“During an open court session earlier today, the Magistrate cancelled the bond for an accused person who had jumped bond and had failed to offer satisfactory explanations for jumping bond. Immediately this decision was pronounced, a person shot at the Magistrate and injured her on the hip,” Winfridah Mokaya, the Chief Registrar of the Judiciary said in a statement.

According to a police report filed at Jogoo Road Police Station, the officer in the shooting incident was identified as 55-year-old Samson Kipchirchir Kipruto, who served as an OCS at Londiani.

The OB report states that the officer’s wife namely Jenniffer Wairimu aged 48 years was an accused person in a case of obtaining money by false pretence, amounting to Ksh2.9 million.
