Ojaamong off the hook: Court dismisses graft case against former Busia governor

Milimani Anti-Corruption Court has acquitted the former Busia County Governor, Sospeter Ojaamong, and eight others of graft charges levelled against them.
The nine were on trial for abuse of office and corruption charges on a project worth Ksh8 million.
The amount was said to have been paid through an illegal award of tender of solid waste management to Madam R Enterprise by Busia County Government in the financial year 2013/2014.
On a judgment delivered by Senior Principal Magistrate Eunice Nyutu on Friday, May 16, 2025, she stated that the prosecution did not provide enough evidence through the 20 witnesses they provided.
“I have perused through the evidence and found that the prosecution failed to prove all the charges against the accused persons pursuant to Section 215 of the Criminal Procedure Code, and I acquit them accordingly,” Magistrate Nyutu ruled.

Notably, she stated that she is not persuaded that the conviction was justifiable and that theirs was a case where the accused ought to have been given the benefit of doubt.
