Judge suspends Matiang’i order to deport 4 Chinese over caning incident

High Court judge has suspended the deportation order issued by Interior Cabinet Secretary Fred Matiangi on the four Chinese nationals who were accused of canning their Kenyan workers.

The Director of Public Prosecutions has been given until Friday, February 21, to file a response.

The lawyer representing the ODPP Jacinta Nyamosi said that they were served with the application late, therefore, pleaded with the court for more time to file responses.

The matter was certified as urgent and the court scheduled the inter-party hearing on February 25.

The four Chinese filed an application challenging the deportation order issued by Dr. Matiangi.

Last week, a lower court directed that the four Chinese nationals be detained for 15 days pending investigations.

“The court has considered the fact that the suspects are a flight risk and they will abscond court if released. I allow their detention for 15 days,” principal magistrate Hellen Okwani ruled.

The four are Deng Heilan, Ou Giang, Yu Ling, Chang Yueping.
