Declare BBI team illegal, Aukot asks High Court

Thirdway Alliance party leader Ekuro Aukot wants the Building Bridges Initiative task force declared unconstitutional and its activities nullified, including the recently-released report.

Dr Aukot claims that Raila Odinga lacks the legal mandate to negotiate with the President.

Submitting before High Court Judge John Mativo, Aukot’s lawyer, Elias Mutuma, said the agreement between President Uhuru Kenyatta and Raila is illegal and unconstitutional and should not have been allocated public funds.

“The President ought to have included all the political players in the handshake. There were other presidential candidates in 2017 race, why Raila only?” said Mutuma.

Aukot told the court that the members of the BBI task force ought to have been vetted

“After the handshake, the President appointed the vision bearers. There was a clear intention to lock out everyone else. The Constitution talks about how and the mode of selection of members to be assigned a public duty,” reads Aukot’s petition.

In his petition, Aukot questioned the criteria used to pick the BBI task force members.

“The appointment of the members of the task force did not comply with Article 10 of the Constitution,” said Aukot’s lawyer.

Aukot claimed that he learnt through the media that Sh10 billion had been used by the task force. The former presidential aspirant wants to know who authorized the BBI team’s budget and how much the task force has spent.
