City car parking usher in court for stabbing colleague in stomach using broken bottle over ksh100 service fee

A 36-year-old man, who works in Nairobi city a car parking usher, risks life imprisonment for stabbing his colleague in the stomach with a broken bottle over Ksh100.

James Lobocho is charged that on July 13, 2021, at Harambee Avenue near Bima House in Nairobi, willfully and unlawfully did the grievous harm to Bernard Apolo Ominde.

According to a police report, on August 13, 2021, at around 3.00 pm, the complainant was at a parking lot along Harambee Avenue where he work as a parking boy when an argument ensued between him and the accused person over Ksh100 that a vehicle owner had given it to the complainant.

“Both the accused and the complainant were drunk at that time when the accused struck a broken bottle on the stomach sustaining serious injury “read the report.

The accused then took off and members of the public alerted the police who arrived at the scene and saw the complainant being rushed to Kenyatta National Hospital in County ambulance.

It is alleged that on August 16, 2021, at around 2.00 pm, witnesses spotted the accused person along Haile Selassie avenue and alerted police who were on patrol. They arrested him and escorted him to station.

James pleaded guilty before Chief Magistrate Francis Andayi but the judge warned him that the offence is serious and attracts life imprisonment. He ordered the charge sheet to be read again to him but he still pleaded guilty to the office. 

The prosecutor Angela Fuchaka told the court that facts are not ready since the complainant is still admitted at the hospital in critical condition and has not filled the p3 form or recorded statement. 

“Your honour I pray that I be given time to allow the complainant who is in critical condition to be able to fill the p3 form and record statement,” Fuchaka said. 

The Magistrate ordered the matter to be mentioned on August 27 2021 for the prosecution to give the status of the complainant and sentencing.
