Businessman in Phanice Chemutai shooting released on bail

Kitale businessman who allegedly shot Phanice Chemutai on July 8 in Kiminini has been released on Ksh200, 000 cash bail after his lawyers led by Cliff Ombeta pleaded with court to free him because he was under medication.

This comes after he pleaded not guilty to the two counts of attempted murder and unlawfully injuring Chemtai whom he mistaken for the killer police Caroline Chemutai Kangogo who is wanted for killing two men.

The lawyers said their client hotelier Ken Muyundo was battling unknown illness and had been rushed to hospital on Friday and only released today to attend to the court case. 

“My client has a medical condition that requires medical attention thus I would like lenient bond terms to enable him to continue with his medication,” Ombeta told the court.

The lawyer notified the court that his client had just been released from the hospital to attend the court hearing and should head back thereafter.

“Since Friday, the day he was arrested my client has been in hospital as the incident shocked him prompting his illness to reoccur and has been hospitalized till this morning when he was released to attend to the case and he is expected back,” Ombeta added.

Lawyer Ombeta further rubbished the case as a small matter adding that they will solve it amicably.

“This is a small matter and should not worry you as we will deal with it since my client never intended it to escalate. It is only you, the media and social media who have overblown it,” Ombeta stated.

Asked his client can accept out-of-court settlement, Ombeta said that it was too early for such a move but they were imploring it to.

“Let the case start as it is premature to discuss such issues but it was one of the solutions we are putting on the table,” he said.

The  Chief Magistrate Julius Ng’arng’ar set July 28 as the hearing date.
