Three Mombasa residents have moved to court seeking orders to revoke, the appointment of nominated Members of the county Assembly of Mombasa.
The trio Julius Ogogo, James Nyanjom and Philip Odongo(listed as petitioners) now claim that among those who were nominated as persons with disability from the marginalized group, he is representing he is not physically challenged.
The petitioners are now seeking orders, to quash the nomination of Solomon Ngungi who has been nominated to represent the interest of people living with disability, while he is not physically challenged, has no certificate filed in the database or presented by Ngungi to depict registration of any type of disability.
“The petitioners further contend that the 5th respondent who has been nominated and was gazetted as a person living with disability from the marginalized groups, however, he is not disabled and he is a man who is physically fit, “reads part of their affidavit.
The petitioners further argue that the 4th respondent listed as Hawa Omar who has been nominated to represent youths of Mombasa is from Lamu Mkunumbi ward, and is not a member of the Orange Democratic Movement party,(ODM)
“The nominations are in direct violation of the law as envisaged in regulation 15, and 26 of the elections, party primaries and party lists regulation’s 2017,” they said.
The petitioners are seeking orders to quash schedule 1 of the marginalized list and schedule 2 gender top-up list of the Mombasa county Assembly on grounds that those nominated are not fit to serve the interest of the people of Mombasa and the marginalized communities.
“A declaration be made that that, the clerk of Mombasa county Assembly, the county Assembly of Mombasa ( listed as respondents) resubmits a list of nominated Members of the Mombasa county Assembly in compliance with the elections party primaries and party lists regulation’s 2017, “reads part of their affidavit.
