Nairobi caretaker in court for evicting tenant maliciously

A rental house caretaker was on Monday, October 11, 2022, charged before Milimani Law Courts with maliciously evicting his tenant.

The court heard that David Wachira, a caretaker of Paward flats located on Desai road in Nairobi county on October 6 this year out of malice jointly with others still on the run, willfully and unlawfully subjected Richard Junior Kubare, his tenant to annoyance with intent to compel him to vacate the premises by removing the door of his house.

The prosecution states that the accused committed the offence out of malice and without no notice contrary to section 29 of the Rent Restriction Act CAP 226 Laws of Kenya.

It is said that on the material date at around 7:15 pm that evening, the accused person confronted the complainant and ordered him to leave the premises or face his wrath.

It was not clear what might have caused the caretaker to take the law into his own hands by subjecting the tenant to such kind of inhumane treatment

The caretaker denied the one charge of subjecting a tenant to annoyance contrary to the law before Senior Principal Magistrate Robinson Ondieki and was released on a bond of Ksh50,000 with an alternative cash bail of Ksh10,000.
