Court sets Ksh100K bail for Naivasha man accused of forging govt documents

A man was arraigned on Thursday, December 4, 2025, in Naivasha Court, facing four charges, including conspiracy to commit a felony.

The bespectacled Zacharia Kamau Ngugi, wearing a brown cardigan, stood quietly in the dock as the charges were read out to him.

The court heard that the accused, jointly with others not before the court, had committed a felony.

“That on diverse dates between June 13 and 31, 2013, with others not before court, he conspired to commit a felony by forging a memorandum of understanding,” the charge sheet read in part.

Ngugi was further accused of forging crucial documents in an attempt to link a company identified as Kamuta Company with the government.

“He forged articles of association for Kamuta Company within the Republic of Kenya,” the court heard.

The prosecution added that the accused faced a second count of making false documents, namely the memorandum of understanding and articles of association, jointly with others, not before the court.

In a third count, the court heard that on December 31, 2013, at the Registrar of Companies’ offices in Nairobi, Ngugi knowingly and fraudulently altered the said documents.

“Namely, the memorandum of understanding and articles for Kamuta Limited submitted to the Registrar of Companies,” the charge sheet read.

The fourth charge stated that, within the same period, the accused knowingly and fraudulently filled in documents containing misleading information about Kamuta Limited.

Appearing for the complainant, lawyer Robert Asembo said they did not oppose the accused being granted bail but called for strict conditions given the nature of the offences.

Ngugi denied all the charges and was granted bail of Ksh100,000 with a surety of a similar amount, or an alternative cash bail of Ksh50,000.

The case is set for mention on December 11, 2025, with a full hearing scheduled for January 1, 2026.
