Wiper-nominated MCA Kana charged with cyber harassment over TikTok post
By Zipporah Ngwatu, August 13, 2026Makueni Wiper-nominated Member of the County Assembly (MCA) Urbanus Kyalo Wambua, alias Kanzala Kana, has been charged with cyber harassment.
The Directorate of Public Prosecutions has charged Kana with cyber harassment contrary to Section 27(1)(a), as read with Section 27(2)(a) of the Computer Misuse and Cybercrimes Act, Cap 79C.
According to the charge sheet, Wambua is accused of using his TikTok account with the username @urbanuswambua1 to wilfully communicate with Kibwezi West Member of Parliament Mwengi Mutuse.
The prosecution avers that Wambua posted a video in which he made inciteful remarks against Kibwezi West MP Mutuse.
Appearing before Milimani Magistrate Joan Mati on Thursday, August 13, 2026, MCA Wambua has denied the charge lodged against him by the State.
The defence team, led by Makueni County Senator Daniel Maanzo, told the court that the charge is politically motivated.
The court heard that the accused is an opponent to the complainant, MP Mutuse, who is also listed as the first prosecution witness in the charge sheet.
The defence informed the court that the accused is eyeing MP Mutuse’s seat, thus terming his prosecution as frustrating his bid to vie for the seat.
Further, they urged the court to grant him reasonable bail and bond terms pending the hearing and determination of the case.
Notably, the defence team told the court that the accused person is a family man and has a fixed abode in Makindu; thus, he is not a flight risk.
“Your honour, we are praying for reasonable cash bail terms for the accused person; he is a Wiper-nominated MCA, and we urge this court to grant him a free bond,” the defence submitted to court.
“Your honour, this is a politically motivated charge, and we submit with a lot of humility for the court to grant the accused reasonable cash and bond terms,” the defence added.
The prosecution, through State Prosecutor Victor Owiti, has not opposed the accused being released on bail and bond terms.
However, Prosecutor Owiti has urged the court not to grant Kana a free bond, noting there is a rampant surge of online incitement by politicians.
“Your honour we are not opposed to bail. But the court should take judicial notice that the accused is a politician,” Prosecutor Owiti told the court.
“Your honour, there has been a surge of offences committed on the internet under the Computer Misuse Act, especially by the politicians. And in the recent past, the politicians have abused the internet,” Prosecutor Owiti added.
The court is set to rule on the bail and bond terms.
